Kaiser Hourly Employees file suit to recover unpaid overtime and wages
Quintilone & Associates is currently investigating unpaid wage claims for the following employees: All persons who are employed or have been employed by Defendants as non-exempt Customer Service Representatives or telephone-based employees, in the State of California who, during any time from four years prior to the filing of this class action to the present, have worked as non-exempt employees.
Background
Plaintiff was employed by Defendant as a non-exempt employee performing the services of a non-exempt Customer Service Representative in Corona, California for Kaiser Foundation Health Plan, Inc. (“Kaiser”) from approximately February 22, 2021, to April 27, 2021. Plaintiff worked overtime during her employment, constituting more than eight (8) hours per day, and more than forty (40) hours per week, without receiving full compensation.
Plaintiff believes that Kaiser Foundation Health Plan, Inc. is a California corporation in good standing and authorized to do business in California. Further, Kaiser Foundation Health Plan, Inc. does business throughout the United States and in California, including Riverside County. Plaintiff filed her initial Complaint, Case Number Case No. CVRI2102203 in Riverside County Superior Court on May 12, 2021. Plaintiff’s Complaint alleges a series of unlawful employment practices including (1) Failure to Pay Overtime Compensation; (2) Failure to Pay Wages For All Hours Worked; (3) Failure to Provide Meal Periods or Proper Premiums; (4) Failure to Provide Rest Periods or Proper Premiums; (5) Failure to Provide Accurate Itemized Wage Statements; (6) Failure to Pay Wages Due and Payable Twice Monthly; (7) Failure to Reimburse Business Expenses; (8) Failure to Pay Wages upon Termination of Employment; and (9) Unlawful Competition and Unlawful Business Practices. Id. The Complaint was amended on August 10, 2021, to include the (10) Violation of Private Attorneys General Act. See our prior post for an explanation of PAGA. Defendant denies all allegations.
